西元2024 年7 月30 日經濟部產業發展署針對我國國產車組裝提出新制作法，如國內車廠要引進中國大陸品牌車款、陸資與國際品牌合資的品牌車款、陸資併購國際品牌之車款、國際品牌在中國大陸廠生產之車款，車廠須提出在地化供應鏈合作價值比率，即俗稱的自製率，且須逐年提高，對於目前已在市面上販售的車款亦有適用。而其管制措施分別透過產發署2024 年10 月14 日發布之「經濟部產業發展署辦理中國大陸車款在地化供應鏈合作價值比率認定作業要點」、「經濟部113 年7 月30 日經貿字第11350300790 號公告」等進行規範。惟營業自由為憲法工作權及財產權保障的內涵，自製率管制措施是否有限制人民自由與權利之情形而有法律保留原則的適用?法令有修正或變更時，對於人民信賴既有的法律秩序應如何予以保護?本文將探討我國國產車自製率管制措施是否有違反法律保留、明確性原則、信賴保護原則、法令不溯及既往原則以及平等原則之情形，並就其限制是否符合比例原則進行研究。;On July 30， 2024， the Industrial Development Administration Ministry of Economic Affairs proposed new regulations regarding the assembly of domestically produced vehicles in Taiwan. Under these regulations， if domestic manufacturers wish to introduce vehicle models from China， the brands hold by joint-venture models between China capital and international， models resulting from China capital’s acquisition of international brands， or models produced by international brands at China facilities， manufacturers must submit a “localized supply chain cooperation value ratio” commonly known as the Domestic Content Rate which must be increased annually. These requirements also apply to models currently on the market. These regulatory measures are stipulated in the “Guidelines for the Determination of the Localized Supply Chain Cooperation Value Ratio for China Vehicle Models” issued by the Industrial Development Administration Ministry of Economic Affairs on October 14， 2024， and the “Announcement No. 11350300790 of the Ministry of Economic Affairs dated July 30， 2024.” However， the freedom of business is protected by the right of work and property in Art. 15 of the Constitution. Do the Domestic Content Rate measures constitute restrictions on the freedom of business by the state powers should meet all the requirements in Art. 23 of the Constitution Among them a statute or regulation explicitly authorized by a statute is required for the public powers to restrain people of his basic rights? When laws or regulations are amended or changed， how to protect the reliance? This paper will examine whether Taiwan’s domestic vehicle Domestic Content Rate measures whether violate the principles of legal reservation， principle of clarity and definiteness of law， principle of legitimate expectation， non-retroactivity of laws， and principle of equality， and will analyze whether such restrictions comply with the principle of proportionality.
