;With the rapid advancement of technology, numerous emerging technologies have been gradually integrated into various fields, such as daily life and healthcare, seeking to foster more efficient and convenient lifestyles. Following the 2008 global financial crisis, governments worldwide, in an effort to prevent a recurrence, catalyzed a wave of expanding emerging technologies into the financial sector, thereby shaping the fields of Financial Technology (FinTech) and Regulatory Technology (RegTech). Adapting to this global trend, Taiwan has prioritized FinTech development as a crucial national policy, which subsequently gave rise to the Financial Technology Development and Innovative Experimentation Act and other related regulations. However, since the implementation of Taiwan′s FinTech innovative experimentation system nearly a decade ago, only four application cases have successfully transitioned into normalized commercial business models. The inflexible commercialization transition mechanism (often referred to as the "landing mechanism"), in particular, has deterred many potential applicants from participating in the experimentation. Accordingly, through literature review and legal methodology, this thesis analyzes the legislative history of the Act and practical application cases. Starting from the early stages of legislative drafts, it conducts an in-depth exploration of the critical issues confronting Taiwan′s FinTech innovative experimentation system, and further proposes recommendations based on the research findings.
This thesis consists of ten chapters. It begins with Chapter 1,
the introduction, which articulates the core research problem. Chapter 2 provides an overview of the origins and developmental trajectory of financial regulatory sandbox systems across various countries, gradually narrowing the focus to the rationale behind Taiwan′s adoption of such a system for its national development. Chapters 3 and 4 analyze the evolution and impact of various draft versions during the initial legislative phase on the current experimentation system. This leads to Chapters 5 through 8, which examine successfully commercialized FinTech experimentation cases. Chapter 9 deepens the discussion on the challenges facing the current commercialization transition mechanism; by comparing successful and unsuccessful cases, it identifies the core structural issues and proposes possibilities for improving the overall legal environment. Finally, Chapter 10 suggests that the competent authorities in Taiwan should moderately relax administrative controls on FinTech innovative businesses to increase applicants′ chances of successful commercialization. Alternatively, it recommends amending specific articles of the Act to establish transitional provisions, thereby preventing the rights and interests of applicants and participating consumers from being compromised during legislative vacuum periods.
