;With the development of modern society, the emergence of novel crime types and rising crime rates have severely burdened the adjudication of criminal cases in Taiwan, leading to the burnout of legal practitioners and an excessive workload for the courts. Protracted and redundant criminal proceedings impose a heavy financial and temporal toll on the parties involved. Even if delayed justice is eventually served, irreparable harm has often already been inflicted. If the judicial system fails to distinguish between the gravity of cases and insists on applying the full, ordinary trial procedure universally, the courts risk gridlock, preventing the efficient concentration of judicial resources. These challenges underscore the urgent necessity for the simplification and summary disposition of criminal procedures in our nation. Prior to the formal codification of Part VII-1 "Bargaining Procedures" into the Code of Criminal Procedure, various alternative mechanisms embodying the substantive spirit of plea bargaining had long operated in practice, such as deferred prosecution, summary procedures, and abbreviated trial procedures. However, since the amendment adding Part VII-1 "Bargaining Procedures" in 2004, its utilization rate in judicial practice has steadily declined over the past six years, falling short of the legislative objective to mitigate the depletion of judicial resources. Consequently, the research focus on plea bargaining in this thesis is strictly confined to the "Bargaining Procedures" stipulated from Article 455-2 onwards. First, this thesis explores the core theories, practical operations, constitutional foundations, and institutional defects of the American plea bargaining system. Analyzing through the framework of the adversary system and prosecutorial discretion (the principle of discretionary prosecution), this study introduces the U.S. plea bargaining system and discusses the dilemmas encountered in its practice to serve as a reference for legislative reform in Taiwan. Second, the discourse transitions to Taiwan′s modified adversary system and the principle of compulsory prosecution, introducing the institutional design, practical application, controversies, benefits, and empirical data analysis of the "Bargaining Procedures" under Part VII-1 of the Code of Criminal Procedure. Finally, this thesis proposes amendments consisting of "four enhancements and one implementation." It is envisioned that through comprehensive legal reform and the establishment of transparent supervisory mechanisms, plea bargaining in Taiwan can transition from its current marginalization in practice to fully manifest the legislative spirit of "expeditious adjudication for clear cases, meticulous deliberation for doubtful ones," thereby transforming into an efficient and just criminal justice system.
