我國《營造業法》自施行以來，對營造產業之經營管理、專業分工及工程責任體系之建構具有重要規範功能，並對維持工程品質與產業秩序發展扮演關鍵角色。然而，隨著工程型態日益複雜、專業分工持續細緻化，以及產業經營環境快速變遷，現行制度於承攬總額限制、專業營造業分類及專任工程人員職責劃分等面向，逐漸與實務運作產生落差並衍生相關爭議。本研究聚焦於承攬總額限制制度、專業營造業分類定位及專任工程人員職責範疇等核心議題，旨在探討制度設計與實務需求間之平衡關係，並研擬兼顧經營彈性與管理品質之制度方向。透過整理現行法規及主管機關函釋，並結合專家學者與產業公會代表之實務經驗，本研究嘗試釐清制度解釋分歧與實務適用問題，進一步提出權責劃分與專業分工之改善建議。最終期望透過制度之適度調整與精進，降低營造業經營不確定性，並促進政府治理、產業發展與工程品質提升之平衡發展。;Since its enactment， Taiwan’s Construction Industry Act has played a significant regulatory role in shaping the construction sector’s business management practices， fostering professional specialization， and establishing a construction contractor responsibility framework. It is also crucial for maintaining construction quality and preserving industry order. However， as engineering projects become increasingly complex， professional division of labor becomes more granular， and the industry’s operating environment changes rapidly， the current system—particularly regarding the" contract value sum" limitation， the classification and positioning of specialized construction enterprises， and the delineation of duties for designated professional engineers—has gradually diverged from practical operations， giving rise to related disputes. This study focuses on three core issues: the "contract value sum" limitation mechanism， the role and positioning of specialized construction enterprise classifications， and the scope of responsibilities of designated professional engineers. Its purpose is to examine the balance between regulatory design and real-world needs， and to propose institutional directions that take both business flexibility and management quality into account. By reviewing existing regulations and guidance directives issued by competent authorities， and integrating practical experience from experts， scholars， and representatives of industry associations， this research seeks to clarify differences in legal interpretation and practical application. It further offers recommendations for improving responsibility allocation and professional division of labor. The study aims to reduce business uncertainty in the construction industry and promote a balanced development that supports government governance， industry advancement， and improvements in engineering quality through appropriate refinement and enhancement of the relevant regulatory system.
