    Abstract: 摘 要
    近年來捷運系統工程儼然成為台灣非常普遍之公共建設,目前亦有數個縣市區域型捷運系統刻正規劃或處於興建階段中,而捷運工程興建過程中容易因為許多外部宏觀或內部微觀的因素使得捷運工程履約爭議層出不窮且難以避免,因此如何有效的減少爭議案件數量或迅速解決爭議即為值得深入研究之課題。故本研究之主要目的為探討國際工程協會FIDIC契約之爭議審議委員會(Dispute Review Board, DRB)機制如何應用於國內捷運系統工程中以及應如何善用此機制之功能以減少或解決履約爭議。
    本研究首先透過文獻回顧探討了國內外設置爭議委員會之緣由與各種相關規定及辦法並將之進行比較與分析,挖掘出該機制仍存在著許多疑惑與運作困難之處。隨後本研究將此些問題利用專家訪談方法,訪談國內具有實務經驗之專家以強化此機制之缺陷與不足使其可更易發揮其效用並順利解決工程履約爭議,最後以桃園機場聯外捷運系統之機電系統統包工程作為案例以資驗證。
    從案例中得知採用此機制共順利解決86件履約爭議案,足證此機制之運作架構及功能是為有效解決工程履約爭議,雖然該案例最終仍有6件履約爭議案無法透過此機制解決,但藉由該機制仍有找到其他救濟方式,因而改採調解、仲裁及訴訟等履約爭議處理途徑。本研究最後得出國內採用此機制雖屬萌芽階段,但確為一個可供未來公共工程解決履約爭議之優先選擇,該機制具有許多優點,不僅可於履約過程中即刻解決問題,減少契約雙方消耗資源與時間,並能有效避免爭議不斷擴大而影響工進。;Abstract
    Massive Rapid Transit (MRT) has been popular in Taiwan and there are numerous regional MRT systems on going for the recent decades. Disputes are inevitable due to changes caused by the macro- and micro- economic statuses. The study objective is to discuss how the implementation of Dispute Review Board (DRB) on MRT cases functions using an empirical case of electrical and mechanical Design-Build (DB) contract for the Taoyuan airport MRT project. A comprehensive literature review has brought the overview for the common methods in dispute resolution and led to the questions for expert interviews. The expertise summary supports a DRB mechanism that constructs the framework for empirical practices. The case study, electrical and mechanical DB contract for Taoyuan airport MRT project, involves 86 disputes, showing that the proposed framework functions well for dispute settlement. Only 6 of which require further resolution such as litigation or arbitration. The proposed mechanism significantly reduced the amount of severe disputes that may consume more resources and time to settle.
